Enshrine Placements have been retained to source Engineering Professionals for the Largest Single Energy Storage Monomer Capacity Project in Africa, for an international client setting up operations in Johannesburg.
This EPC project – located in the Matzikama region of the Western Cape with a contract value of ZAR 1.85 billion – includes design, supply, installation and commissioning of a new 80MW/320MWh electrochemical energy storage station and expansion work of a 132kV substation. This is our clients first ever overseas electrochemical energy storage project; they topped the evaluation results in both technical and commercial standards, competing against 10 top general contractors.
They currently have an exciting new opportunity available for a Compliance / Legal Manager to manage EPC construction claims identification, avoidance, defense, and prosecution.
Type: Contract (duration of contract: 1 year with the potential of being extended.)
Primary purpose: As a Legal Commercial / Claim Manager, you will be required to manage EPC construction claims identification, avoidance, defense, and prosecution.
Job description / core competencies:
Manage all legal matters on the project.
To be a single point of contact for the claims and disputes and to manage the claims and dispute resolution process.
Provide analysis and evaluation of claims which have not been resolved at project level, including evaluation of both contractual and legal entitlement identify, collect, and evaluate relevant facts and records.
Collate related information and provide analysis based on facts, records and the contract.
Prepare, brief, and advise strategies claim resolution, defences, and counterclaims.
Prepare reports and recommendations related to claims and disputes evaluate quantum.
Manage delay analysis process for all planning/time elements of claims advise appropriate methods of delay and program analysis.
Dissect construction programmer for the purposes of assessing entitlements.
Prepare and provide substantiation and advice related to all claims.
Produce well-written, concise reports and letters, with minimal revisions required.
Provide all appropriate advice and support to Company Contracts Directorate departments regarding all disputes.
Manage the input of the commercial view into the client’s decision-making process around triggering disputes and/or litigation.
Assist the team with contractor’s applications, certifications, variations, and claims.
Adhere to and maintain familiarity with any procedures regarding items such as contract administration, claims management, employer’s claims and contractor’s and document Inspections.
Provide independent conclusions and recommendations
Advice on all matters of a potentially contentious nature related to the project and undertakes the evaluation of claims. Identify and evaluate key records and facts; evaluate all parties’ contractual and legal entitlement; advise on claim resolution strategy, client defense strategy, and program analysis; and evaluation of quantum.
Manage disputes, ensuring that robust contractual, factual, and commercial input is considered.
Work closely with Contracts Directorate to ensure that contractor’s exposure is correctly diagnosed, accurately reported and where appropriate, effectively mitigated.

Job Qualification & Experience:
Degree in law.
Minimum 10 years’ experience in the handling and management of claims and disputes on major infrastructure projects.
Extensive experience working with FIDIC, NEC and GCC suite of contracts.
Wide-ranging experience of roles and positions within the construction industry including roles with clients and contractors/subcontractors.
